Welcome to Sanik School MCQ mobile app. These Terms and Conditions (the Terms) are a legally binding agreement between you (“you,” “your,” or “User”) and Concord Technosoft Pvt Ltd (“we,” “us,” or “our”). By downloading, installing, registering an account, or using our mobile or web-based application (the App), you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not be permitted to use the App, and you should discontinue its use immediately.
1. Eligibility and Age Requirement
Our App is intended for individuals who are at least thirteen years of age (“13”). By registering an account, you represent and warrant that you are at least thirteen years old. If you are under eighteen years of age, you further represent that you have the express permission of your parent or legal guardian to use the App. We do not knowingly collect personal information from children under the age of thirteen, nor do we permit such individuals to register for accounts. In the event we become aware that a user is under the age of thirteen and is using the App without validated parental consent, we reserve the right to immediately terminate or deactivate that user’s account and to delete associated data, in accordance with the terms of our Privacy Policy.
2. Parental Guidance
If you are a parent or legal guardian of a user under eighteen years of age, you are responsible for monitoring your child’s use of our App. You agree to supervise the child’s activities, review all settings and privacy controls, and ensure the child’s use of the App complies with these Terms. You may also contact us to request review or deletion of data associated with your child’s account. We are committed to providing a safe and educational environment and encourage parental involvement.
3. User Accounts and Registration
In order to access certain features of the App, including connecting with other users, sharing questions, tracking levels, and viewing connections, you must register for an account. To register, you may be required to provide personal information, including but not limited to email address, username, profile picture, and date of birth. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities conducted under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. License to Use the App
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable worldwide license to download, install, and use the App solely for your personal and non-commercial purposes. This license is conditioned on your continued compliance with these Terms. All rights not expressly granted herein are reserved by Concord Technosoft Pvt Ltd and its licensors.
5. User Content
The App allows you to answer questions, share questions with others, and contribute other materials such as comments, feedback, or images. Any such content (collectively “User Content”) that you upload or submit remains your property. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, distribute, prepare derivative works of, display, and perform the User Content in connection with the App. You represent that you have all necessary rights to grant this license, and that your User Content does not infringe the rights of any third party or violate any law. You agree not to submit User Content that is unlawful, harmful, abusive, defamatory, infringing, or otherwise objectionable. We reserve the right to remove any User Content at our sole discretion without notice.
6. Question Sharing and Connections
You may share questions with other users via a generated link or through in-app sharing. When the recipient opens the link, answers the question, and confirms acceptance of the challenge, the App may establish a “connection” between your account and theirs. This connection enables in-app sharing of questions directly between connected users, and displays basic progress indicators such as usernames, levels, or completion statuses. Neither full responses nor personal data beyond these indicators is shared. At any time, either user may sever the connection or adjust visibility preferences through privacy settings.
7. Levels, Achievements, and Leaderboards
The App measures user engagement through a points and level system derived from question-solving activity. Your level, and in some configurations your points or achievements, may be visible to other users through leaderboards or within your network of connections. These features are intended to motivate participation and should be used responsibly. Misuse or manipulation of these features may result in suspension of account privileges.
8. Privacy and Data Collection
Please refer to our Privacy Policy, which describes our collection, use, and sharing of your personal information in detail. By using the App, you acknowledge that you have read and agree to the Privacy Policy. We do not sell or rent personal data. Any use of data is intended to improve the user experience, ensure compliance with applicable law, or for legitimate business purposes such as analytics and customer support.
9. Subscription, Fees, and Payments
Currently, our app is completely free to use, and no payment or subscription is required to access any features. We may introduce paid plans or additional services in the future, but only after gaining sufficient user traction. Any such changes will be clearly communicated in advance.
10. Acceptable Use
You agree to use the App only for lawful and appropriate purposes. You must not use the App in any manner that could disable, damage, or impair our services, or that could violate any applicable local, national, or international law. You agree not to use the App in ways that infringe on the rights of others, including intellectual property or privacy rights. You must not attempt to interfere with the App’s security, disrupt its operation, or attempt to access restricted portions without authorization. We reserve the right to investigate and take legal action against anyone who violates this provision.
11. Intellectual Property and Ownership
All content within the App – including text, graphics, code, user interface, design, and audio – is the property of Concord Technosoft Pvt Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws. You will not remove or alter any proprietary notices on any part of the App. We respect the intellectual property rights of others; if you believe your rights have been infringed, please provide written notice to our Designated Agent as outlined in our DMCA Policy.
12. Deactivation, Suspension, and Termination
We reserve the right to suspend or terminate your access to the App or your account at any time for any reason, including without limitation if you breach these Terms, act inappropriately, or request such action. Termination will not relieve you of obligations incurred prior to termination, including payment obligations or warranty disclaimers. We may also delete or archive your account and User Content according to our Privacy Policy and applicable laws.
13. Modifications to the App
We may update the App periodically, and these updates may include bug fixes, new features, changes, or enhancements. You agree that we have no obligation to provide maintenance, support, or updates for the App, though we may choose to do so. The App may require automatic updates; you agree that we may install these updates without prior notice unless prohibited by law.
14. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis, without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant that the App will meet your requirements or be error-free or secure. We will not be liable for any interruptions or for any virus, worm, or disabling feature incorporated into the App.
15. Limitation of Liability
To the maximum extent permitted by law, Concord Technosoft Pvt Ltd and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages arising out of or related to your use of the App. These include, without limitation, damages for loss of profits, goodwill, data, or other intangible losses. In jurisdictions where such limitations are not permitted, our liability will be limited to the greatest extent permitted by law. In no event shall our total liability to you exceed the amount you have paid, if any, for the App.
16. Indemnification
You agree to indemnify, defend, and hold harmless Concord Technosoft Pvt Ltd, its affiliates, officers, employees, agents, licensors, and partners from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from or in any way connected with your violation of these Terms, misuse of the App, or your infringement of any third-party rights.
17. Governing Law and Dispute Resolution
These Terms and the relationship between you and Concord Technosoft Pvt Ltd are governed by the laws of Delhi, India, without regard to its conflict of law principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in Delhi, India, and you consent to personal jurisdiction and venue in these courts.
18. Changes to the Terms
We may modify these Terms at any time. If we revise the Terms materially, we will provide notice via the App, email, or other means. Continued use of the App following such changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must cease using the App and uninstall it.
19. Severability and Waiver
If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary so that the remaining provisions remain in full force and effect. Failure by us to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
20. Third-Party Services
The App may integrate with third-party services, such as analytics, advertising, or social platforms. Your use of those services may be subject to additional terms. We are not responsible for the content, practices, or privacy policies of those third parties. Integration or linking does not imply endorsement or affiliation.
